Ofcom asked about PMR 446 prosecutions In a reply to a Freedom of Information request Ofcom acknowledged they have never prosecuted a user of PMR 446
Ofcom were asked:
I was wondering if itspossible to give me figures as to how many prosecutions have been made against person or persons for the specific offence relating to using equipment on the PMR 446 band (446Mhz) against the licencing conditions. I appreciate this is a licence exempt band, but for example can you tell me if anyone has ever been prosecuted for using equipment above the permitted .5 Watts or for using an external antenna.
Ofcom replied:
We are not aware of any prosecutions against any person(s) for specific offence relating to using equipment on the PMR 446 band (446Mhz) against the licencing conditions.

I think this is probably the case for some of the License bands aswell, I feel that OFCOM have too many other things to concentrate on at the moment ?

Ofcom definitely have better things to do.....
This could be a case of a freedom of information request to see if you can get away with a Baofeng at full power.....
...or more likely someone with nothing better to do and bemoaning the PMR DX'ers.

i think this some one with to much time on there hands and is using pmr and he has been using pmr. and had some kids and has asked them to move and been to were told go and been told to f..k off so in order of been spiteful has been to Ofcom, An the return has not the answer he needed to hear, and as you said victor some one throwing the dummy

But also make the PMR446 band unusable for the legitimate personal and business users for whom the band was intended. It's a licence-exempt low-power service with a specific purpose. Why spoil it for others when you can buy a Private Mobile Radio (PMR) / Business licence or pass a simple exam to become a licensed Radio Amateur.
In discussions like this, I see statements like "I use PMR446 to get away from Amateurs" and in the same thread "the Amateur bands are dead so they're all coming on PMR446 with high power and big antennas".
Which is it lads?!

It would be totally pointless running that power on 446 because your still not going to hear others coming back to you. Remember that UHF is point to point comms, very directional so having that much power would be counterproductive in general unless you plan on doing Moon bouncing in which case the 70cm band would be more appropriate.
